Regulatory Update: Strategies for Avoiding Class Actions and Complying with FDA and FTC Guidelines

In addition to an increased level of broad-based commercial litigation of personal care companies, there have been numerous regulatory changes in the past year at both the State and Federal Levels that affect our industry. Litigation involving allegations of false advertising, unfair competition and lack of sufficient consumer protections target non-compliant products as well as misleading advertising by cosmetic companies. And despite limited resources, the FDA has managed to issue numerous Warning Letters with increased West Coast activity this year. Once received and posted on the FDA website listing the alleged violation, these stern caution letters require time-consuming and expensive remedies and can result in serious penalties, not to mention company embarrassment and loss of consumer confidence. What claims are not acceptable for Cosmetic products? How do we avoid the pitfalls of increased Class Action suits? And how can we responsibly monitor the validity of our product claims?  These questions will be addressed by our two BIW speakers this October, as well as providing an overview of recent regulatory activity at the State & Federal levels.

SPEAKERS:

Ronie M. Schmelz, Attorney,Tucker Ellis LLP  has a deep knowledge of laws affecting the cosmetic industry and represents clients in broad-based commercial litigation, with a particular emphasis on consumer class action defense. She regularly counsels clients on litigation-avoidance strategies and ensuring compliance with state and federal laws, including regulations enforced by the Food and Drug Administration (FDA), Federal Trade Commission (FTC), and other regulatory agencies; California Proposition 65; and advertising, labeling, and claim substantiation. Ronie has particular expertise in representing domestic and international companies in the cosmetics, personal care, and consumer product industries, and is a member of BIW and CEW and is on ICMAD’s West Coast Development Committee, and was recently appointed as BIW's Legal Advisor to the Board.
