Walking the Tightrope: The Rules Governing Cannabis-Derived Ingredients in Cosmetics
A recent survey of nearly 4,200 female and male personal grooming consumers noted that 64% of all women surveyed are aware of beauty products containing hemp or cannabinoids, and 30% have actually purchased these products (Source:Benchmarking Company Survey, July, 2018). With the continued growth and more widespread acceptance of medical and recreational marijuana as legal in the United States, the cosmetic industry is having to grapple with both the confusing Federal stance as well as what is legal from state to state in order to set a course for legally marketing CBD-based cosmetics from Cannabidiol and Hemp Oil for personal care across the United States. Our speaker will discuss the impact of the 2018 Farm Bill which, among other things, legalizes the production and transport of hemp and hemp-derived CBD products.
William Tarantino has significant experience defending the safety and efficacy of herbal supplements and functional foods. He served as lead national trial and coordinating counsel for Iovate Health Sciences in multidistrict and state court product liability and consumer class litigation, In re Hydroxycut Marketing and Sales Practices, which alleged that key botanical ingredients were responsible for liver and muscle injuries. He has counseled numerous clients through investigations by the Federal Trade Commission, the California Attorney General, and various advertising and industry task forces formed by California’s DA. He frequently advises clients on regulatory compliance with cosmetic, food and supplement laws, and the necessary scientific substantiation for health claims. For the past five years, San Francisco Magazine has recognized Mr. Tarantino in its “Super Lawyer List” for his work in environmental and consumer litigation. In 2014, he was chosen as the exclusive winner of the Client Choice Award for Environmental Law in California and as a Rising Star in Environmental Law by Law360. Mr. Tarantino has an active pro bono practice and currently serves as a member of Morrison & Foerster’s Pro Bono Committee. In 2015, he began his service on the Bar Association of San Francisco’s Board of Directors.
Mr. Tarantino received his J.D. from the Georgetown University Law Center with honors, and completed the Law and Public Health Program sponsored by Georgetown University and the Johns Hopkins Bloomberg School of Public Health. Through this program, he earned a master’s in public health as well as specialty certification in environmental health risk assessment from the Johns Hopkins Risk Sciences and Public Policy Institute. His bachelor’s degree is from the University of California, Berkeley.
